OUR CONDITIONS ALWAYS APPLY

  1. In return for us agreeing to consider your order, you agree that these conditions apply.

NOT OBLIGED TO ACCEPT ORDERS

  1. We are not obliged to accept any order from you. If you place an order with us then it becomes binding from the moment that we accept it even if we do not tell you it has been accepted.

OUR CONDITIONS OVERRULE ANY ORDER FORM

  1. These conditions apply and prevail even if they are inconsistent with anything said or implied in any earlier or later order form or similar document.

RETURN OF GOODS BY YOU

  1. You may return any item you have ordered from us online. Please ensure you have complied with the following return policy to enable us to fully refund your purchase.

For all national orders the products must be returned to Brigid McLaughlin Pty Ltd Head Office within 14 days from invoice date along with the completed returns form.

For all international orders the products must be returned to Brigid McLaughlin Pty Ltd Head Office within 28 days from invoice date along with the completed returns form.

 

You must pay all return expenses and insurance costs to ensure the goods are returned in good order

and promptly. We unfortunately cannot accept responsibility for lost returns parcels and strongly

recommend you register any packages to ensure they are traceable.

 

To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. Products must be returned in secure packaging to prevent damage during transit. You’ll also need the receipt or proof of purchase.

If your return is accepted, we’ll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

Damages and issues

Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

 

 

Exceptions / non-returnable items

Certain types of items cannot be returned, like perishable goods (such as food, flowers, or plants), custom products (such as special orders or personalized items), and personal care goods (such as beauty products). We also do not accept returns for hazardous materials,

flammable liquids, or gases. Please get in touch if you have questions or concerns about your specific item.

 

We cannot accept returns on gift cards.

 

 

Exchanges

The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item. Alternatively contact us at shop@brigidmclaughlin.com if you prefer to exchange without making a second transaction.

 

 

European Union 14 day cooling off period

Notwithstanding the above, if the merchandise is being shipped into the European Union, you have the right to cancel or return your order within 14 days, for any reason and without a justification. As above, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

 

 

Refunds

We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within 10 business days. Please remember it can take some time for your bank or payment gateway to return the funds to you.

 

 

CANCELLATION OF ORDERS BY US

  1. Prior to delivery, we may cancel an order or cancel part of an order without any liability for damages or otherwise.

PRICES

  1. All prices are in Australian dollars.
    7.For all national orders over $200, shipping is free. For any orders under $200 a flat postage charge of $15 will be added at the checkout.
    8. For international orders, delivery to all countries outside of Australia is free for all orders over $400. For any orders under $400 a flat postage charge of $60 will be added at the checkout for delivery, handling and insurance. International customers are liable to pay all import duties, custom taxes, local sales taxes and other fees which may be charged on the purchase. Similar to shipping costs, these costs and any additional costs incurred when returning/exchanging goods will not be refunded. Whilst international customers are not required to pay GST, we charge the international GST inclusive price, and put this percentage amount towards shipping costs. Therefore, the price you see on the website is the price you are charged at the checkout; for all international orders valued at A$400 or over.
    9. Brigid McLaughlin Pty Ltd prices are subject to variation without notice. The price payable for the goods shall be the price confirmed on the date the goods are ordered.

PAYMENTS

  1. Brigid McLaughlin accepts payment online by Visa, Master card, American Express, Paypal, AfterPay or Electronic Funds transfer (EFT).

DELIVERY

  1. We will require someone to sign for your order on delivery, so please ensure that the address you provide has someone there to sign for it during business hours 9am-5pm. If there is no one to sign for a delivery it will usually be returned to your local post office and held for your collection.
    12. National orders will generally be sent by Australia Post and a tracking number will be provided. International orders over the $400 threshold are usually sent with DHL and may take up to 14 days to deliver. International orders under the free shipping threshold of $400 are usually sent with EPS and may take 14 to 20 days to deliver.

ESTIMATED DELIVERY TIMES

  1. Delivery times are estimates only. We will endeavour to deliver all national orders to you within 2-5 business days and all international orders within 7-14 working days. Delivery times cannot be guaranteed.

RISK AND TITLE

  1. You accept the risk of damage to or loss of anything that we supply to you, from the date of delivery. Once goods are in your ownership you are responsible for their insurance.

WARRANTIES

  1. No warranties except those implied and which cannot be excluded by law are given by us in respect of goods and services supplied. Where it is lawful to do so, our liability for breach of a condition or warranty is limited to the repair or replacement of goods, the supply of equivalent goods, the repayment of the cost of repairing or replacing the goods or acquiring equivalent goods, the supplying of the services again or the payment of the cost of having the services supplied again, as determined by us.

EXCLUSION OF IMPLIED CONDITIONS

  1. The law implies various terms, conditions and warranties which might apply to us supplying goods and services to you. We exclude all those conditions and warranties to the fullest extent permitted by law.

OTHER DAMAGES CLAIMS EXCLUDED

  1. We are not liable for any damage for breach of contract, or negligence, except as stated.

UNEXPECTED DELAY

  1. We are not responsible for delay caused by something outside our reasonable control which makes performance in the usual way impractical. Without limiting those general words, this applies where we have problems due to accidents, strikes, transport difficulties or stock shortages.

VARIATION OF THESE CONDITIONS

  1. These conditions may only be varied by one of our authorised officers signing a document which states the variation, and the transaction to which the variation applies.

JURISDICTION AND APPLICABLE LAW

  1. You agree that the contract for supply was made in the State of New South Wales and that the applicable laws are the laws of New South Wales, Australia.

PRIVACY

  1. Your privacy is of great importance to us. All information submitted will be saved securely.

28.We do not sell, trade or rent your personal information to others. However, we do use other companies and individuals to perform services on our behalf, such as delivering packages, sending mail or emails and processing payments. They will have access to your personal information in order to perform these services, however are not authorized to use your information for any other purpose.

PRODUCT INFORMATION

  1. All sizes are based on standard Australian sizing. All sizes are approximate; however we do attempt to ensure they are as accurate as possible. Please refer to the size guide for measurements and for comparable international sizing standards.
    30. We attempt to display product colours as closely as possible on our website. However we cannot guarantee that your monitor’s display will accurately reflect the actual colour of the product.
    31. We undertake reasonable care to ensure that all our details, descriptions and products prices on our website are correct at the time when the relevant content was entered into our Ecommerce Store. We reserve the right to refuse orders where the product information has been mis-published, including prices and promotions.
    32. Goods are subject to availability. As there is a delay in the time when the order is placed and the time when the order is accepted, the stock position of a certain product may change within this time period. If an item you have ordered becomes out-of-stock before your order has been accepted we will notify you as soon as possible. You will not be charged for any out-of-stock items.

Each outfit or review shared with us will be an entry into our monthly draw for a $50 voucher, so share as many as you like. We will draw a name using a random number generator and contact the winner each month via email or Instagram.

- Names are drawn via random number generator on the last day of every month.
- You can enter as many different outfits or reviews as you like. So the more you send/share with us, the more entries.
